"SPAY" SALES AGREEMENT

Hope Springs Kennels/Kimberly W. Campbell ("Seller") and the undersigned Buyer ("Buyer") intend to be legally bound by this Agreement and agree to the following:

In consideration of payment in full of the reduced purchase price of $ by Buyer to Seller, Seller agrees to transfer to Buyer, subject to the terms and conditions contained in this contract, the ownership of one Male/Female Siberian husky Puppy, herein after referred to as the ("Puppy") regardless of age, listed below, from the mating of the sire and dam identified below.

1. Buyer must have Puppy examined by a licensed Veterinarian within 10 days of possession of Puppy. Buyer must also submit to Seller proof that this has been done. Initial ___

2. Seller guarantees that Puppy will be free of adenovirus2, bordtella, distemper, Parainfluenza, and parvovirus for a period of 15 (fifteen) calendar days after delivery. Seller will provide a vaccination record and veterinary examination record of the purchased Puppy. If Puppy is due for vaccinations, and Buyer fails to provide vaccinations on that day, this guarantee is null and void if Puppy contracts diseases that would otherwise be prevented by those vaccinations. 3. Seller shall not be responsible for any medical costs incidental to Puppy after delivery. Seller guarantees Puppy to be healthy at the time of the sale. Seller does not assume any liability for any injury to Puppy after time of sale. If there is a problem with Puppy, Seller's Veterinarian and Buyer's Veterinarian must agree upon health reasons that existed before time of purchase, provided Puppy has been properly cared for in Buyer's possession. 4. Seller guarantees Puppy to be free of any genetic or hereditary defects such as, but not limited to, hip displaysia, epilepsy, etc. up until 2 years of age. If puppy is found to have a defect, Seller will replace Puppy or refund purchase prices once Puppy has been returned to Seller. Buyer will have the choice of compensation. Initial ___

5. If Puppy dies within 24 hours of delivery, Buyer must have an autopsy performed by a licensed Veterinarian at Buyer's expense to determine cause of death. If cause of death is due to problems existing before delivery and after Seller's veterinarian has examined Puppy, compensation will be arranged in the form of a replacement Puppy or reimbursement. The replacement Puppy will be of same equal value. A replacement will only take place if Puppy has been properly cared for in Buyer's possession. UNDER NO CIRCUMSTANCES WILL REPLACEMENT OF A PUPPY TAKE PLACE IF THE ABOVE CONDITIONS ARE NOT MET. Puppy must be returned within 24 hours after which time replacement of Puppy is forfeited. 6. Seller is not responsible for immunity levels, mites, pneumonia, mange, heatstroke, ringworm, conjunctivitis, fleas, ticks, and ear infections once Puppy has left Seller's hands. Buyer is responsible for keeping their Puppy away from contaminated areas, out of the heat and cold drafty places. Initial ___

7. Seller shall provide to Buyer registration certificates (individual) for each Puppy. If the certificates have not been received from the registries at the time of sale, Seller will provide Buyer evidence that the registrations have been applied for, and upon receipt from the registries, Seller will forward the certificates to Buyer. 8. Buyer agrees to have Puppy altered (spayed or neutered) by the date noted above. Initial ___

9. Seller will allow Buyer to change Puppy’s registered name through the AKC or CKC (whichever is appropriate) and agrees to sign the permission form for the registering club allowing Buyer to do so. Buyer agrees, however, to keep the prefix “HSK’s” in the Puppy’s new registered name. Initial ____

10. IF BUYER PREFERS COMMERCIAL SHIPMENT: Seller will arrange air shipment for Puppy, however, Buyer will pay the cost of any and all arrangements and expenses for commercial shipment of Puppy. Seller prefers not to commercially ship a Puppy before 7 weeks. Seller encourages all shipments to take place prior to 12 weeks. Seller shall not be responsible for the safety of Puppy while in transit to Buyer, to include any and all incurred injuries as a result of transportation accidents. Initial ___

11. Buyer agrees to provide annual vet exams, including heartworm checks and preventatives and to do all vaccinations yearly. Failure to comply with and provide documentation of these requirements voids all guarantees. Buyer further warrants that Puppy will be kept in appropriate conditions for its health and welfare. Puppy will be fed a suitable diet for its age and condition. Puppy will receive regular booster vaccination. Puppy will receive all necessary veterinary care to maintain its good health. Remember to keep your Puppy clean. (See #5) Initial ___

12. Under Seller’s care, Puppy shall receive dewormings at 2, 4, & 6 weeks. Seller does not guarantee Puppy to be free of Hookworms, Roundworms or Coccidia, all which are common in puppies and especially in a kennel environment. If Coccidia is found in Puppy while in Seller’s care, Seller will begin a course of treatment that will need to be continued by Buyer once Buyer has possession of Puppy. Seller will administer Puppy its first set of shots (DA2PPv) at 6 weeks. Under Buyer’s care, Puppy will receive its second set of shots at 9 weeks, the third set of shots at 12 weeks, and rabies shot and fourth set of shots at 15 weeks. After 15 weeks, yearly vaccinations are required. Initial ___

13. There will be no replacement for ill temperament, as this is environmental and Buyer's responsibility. Seller is not responsible for any damage Puppy might do at any age. Initial ___

14. If Puppy becomes lost or stolen, Buyer agrees to notify Seller immediately. Seller will not be responsible for this loss and Seller will not refund the purchase price of Puppy, nor will Seller give another Puppy for replacement. Initial ___

15. If, at any time, Buyer is unable or unwilling to care for Puppy, Buyer agrees to contact and return Puppy to Seller. Neither REFUND, NOR REPLACEMENT OF PUPPY WILL BE GIVEN. Initial ___

16. Buyer agrees to, and understands the following conditions:
Puppy shall not be sold, leased or given to any pet shop or research establishment. Buyer further agrees that Puppy shall not be used for medical or any other experimental purposes or sold to supplier, wholesaler, shelter, pound, or humane society. If Buyer violates this clause, Buyer must pay a fine of $500 to Seller, which Seller will then donate to the North Carolina Siberian Husky Animal Rescue (NCSHAR). Initial ___

17. Buyer agrees to notify Seller within 30 days of any change of address or phone number. Initial ___

18. Seller may examine and make inquiries about Puppy at any time. If not satisfied with the condition of Puppy or the conditions in which it is kept, Puppy can or may be removed immediately. NO REFUND OR REPLACEMENT OF PUPPY WILL BE GIVEN. Any veterinary services needed due to negligence or lack of care, will be Buyer's responsibility and payable to Seller. Initial ___

This contract contains the entire agreement between the parties and no statement or verbal agreements made by either party that are not contained in this written contract shall be valid or binding. This contract may not be modified or altered except in writing and signed by both parties. Violations of this contract will constitute BREACH of CONTRACT, prosecutable by law, and may result in mandatory confiscation and return of Puppy to Seller. Any disputes will be resolved in a Chatham County, NC venue.
