CONDITIONS OF SERVICE
1. Upon signing of this agreement I do hereby swear that I am the owner of this bitch and have the legal right to breed her.
2. I attest that this bitch is AKC registered (with breeding rights) and that I am in good standing with the AKC.
3. I attest that this bitch is at least 22 months of age at the time the breeding takes place.
4. I attest that I have the bitch's best welfare at interest and that I am able and capable of caring for this bitch and her litter.
5. The stud dog and bitch owners agree that two (2) puppies surviving at least forty-eight (48) hours constitute a litter.
6. The bitch owner agrees to provide the stud dog owner with a photocopy of the bitch's AKC certificate before mating takes place.
7. The stud dog owner agrees that if successful mating has not occurred, or if the bitch failed to conceive, the bitch owner reserves the right to choose to have any monies paid thus far returned, or to have the bitch and stud dog mate again when the bitch enters her next heat cycle.
8. The stud dog and bitch owners agree that the stud dog owner will have the right to the pick of the litter. At no time will the stud dog owner's pick be sold to a third party. The stud dog owner's pick will be AKC registered, by the bitch owner, to the stud dog owner with full breeding rights. The stud dog owner reserves the right to use the kennel prefix of HSK upon naming the puppy. Stud dog owner agrees to include the bitch owner's kennel name as a suffix, if requested. The stud dog owner reserves the right to be paid $300.00 for stud fee in lieu of pick of the litter.
9. The owner of the bitch agrees to pay all expenses incurred for the purpose of this breeding at the time they are incurred, e.g. transportation of bitch, veterinary costs, etc.
10. Breeding shall take place at the stud dog owner's address. Stud dog owner agrees to submit to bitch owner, in writing, the dates the bitch and stud dog were mated as well as the number of times mating occurred.
11. The stud dog owner swears to take care of the bitch to the best of her capability, to protect the bitch from any harm and to ensure that no male dog, other than said stud dog, will have access to the bitch.
12. The bitch owner hereby releases the stud dog owner from any responsibilities, liabilities and/or damages while the bitch is in the stud dog owner's care. Initial ___
13. The bitch owner promises not to transfer ownership in any way, of any puppy resulting from this breeding to any person or organization whose intent it is to resell, trade or give away the puppy for use in a puppy mill breeding program or for use in laboratory experiments.
14. The bitch owner agrees to be responsible for the offspring of this breeding and further agrees to take back any dog from this breeding if the purchaser can no longer keep them. The bitch owner agrees to not knowingly let any puppies from this breeding be placed in a shelter or rescue.
15. I/We the undersigned have thoroughly read and understand the contents of this agreement and acknowledge this to be a binding contract. Willful misrepresentation will be considered fraud and subject to legal prosecution in a Chatham County, NC venue.
